Mediawatch defend SCA…sort of

Staff Writer

The major focus on Media Watch last night was commercial radio, and for a change no mention of Alan Jones.

And on this occasion, in a sense, Media Watch were defending Southern Cross Austereo's legal action in the Federal Court over the ACMA's right to investigate the prank call from December.

SCA's legal action is based on their position that ACMA has no power to investigate if the recording of the phone conversation breached any Federal or State laws.

Therefore, in SCA's view, given that there is no investigation by the NSW Police, ACMA has no right to take action over the call.

Jonathon Holmes summarised by saying;

"But whatever you think of 2Day FM’s behaviour, or of that prank call, it does seem concerning that a government agency thinks it can act as prosecutor, judge and jury in what is essentially a criminal matter."
