PPCA appeals radio simulcast decision

Staff Writer

A fortnight ago the Federal Court ruled in favour of the commercial radio industry (read here) over the issue of royalties for streaming being considered separate to the terrestrial broadcasts.

The ruling effectively allowed radio to stream online the same program that it puts to air through the transmitter for no additional royalty fees.

The PPCA argued that the commercial radio stations should be required to pay additional fees for streaming of the on-air program. PPCA CEO Dan Rosen said following the decision on February 15 – ''We are disappointed by this ruling on a technical point relating to internet streaming".

Late last week the PPCA lodged an appeal to the Full Bench of the Federal Court. A date for the hearing is yet to be determined.
